Summary/Abstract: This article aims to analyze the obligations of the parties to the franchise agreement in order to assess the extent to which the freedom to contract and the balance of the parties' performances are found in this contract as regulated by the Govern Ordinance no. 52/1997 regarding the legal regime of the franchise. Also, based on the conclusions, proposals are submitted de lege ferenda in order to improve the legal regime of the franchise, useful for professionals-traders, but also for legal professionals.
