The Use of Mursal Concept in The Third Hijri Century: A Case of Abū Dāwūd's Sunen

Summary/Abstract: In order to determine the authenticity of a hadith consisting of a sanad and a text, a number of principles were determined by the muhaddiths. Some of these principles are related to the sanad and some of them are related to the text. One of the faults that necessitate a hadith to be weak in terms of the isnad is the disconnections in the sanad. These disconnections were gathered under the title of munqati’ and were called with different names according to the place of the disconnection. One of the hadith types under the headline of munqati' is mursal hadiths. Mursal hadiths have been the subject of debates dating back to early times, both in terms of content and whether it is a hujjat or not. The early usages play a leading role in determining the content of the concepts. Because while defining the concepts in the later periods, a framework is tried to be drawn by looking at the usage characteristics of the scholars of the first period. One of the scholars whose usage was effective in determining the content of the concepts in later periods is Abū Dāwūd. His evaluations of some hadiths in his Marāsīl and his Sunan, which he compiled independently on the mursal hadith literature, are important in determining the content of this concept correctly. In this study, the thirteen uses of mursal hadiths identified from Abaū Dāwūd's Sunan will be examined one by one, and it will be tried to reveal in which context Abū Dāwūd, one of the scholars of the third hijri century, used mursal.
