Summary/Abstract: This study has as subject special situation selected from jurisprudence, in which the criminal investigation entities requested a new confirmation of a solution to waive criminal investigation after previously having ordered to reopen the criminal investigation caused by the non-fulfilment in bad faith of the obligations imposed. It was ascertained that in the case the criminal investigation entities did not request the confirmation by the preliminary chamber judge of the solution to reopen the criminal investigation. The study presents the incident legal texts, the respective case, the identified relevant doctrine as well as the author’s appreciations regarding the solution ordered.
