Summary/Abstract: The paper deals with the question of foreseeability of judicial decisions, respectively court proceeding in civil matters in general. The main objective of the article is to reflect on the civil proceeding in terms of fulfilling of one of the fundamental components of the right to a fair trial, which is the foreseeability of judicial procedure. It includes consideration of the question, what instruments should legislators use to prevent surprising decisions that fundamentally undermine the legitimate expectations of participants and legal certainty. The article includes an evaluation of current legislation and proposals de lege ferenda. Th e novel Bleak House by Charles Dickens serves the author for the purpose of demonstration of the fact that this problem is part of the general development of the judiciary and has a marked impact on the everyday reality of participants.
