Summary/Abstract: In this work, the author analyzes the Treaty establishing the Energy Community from the aspect of environmental protection and in relation to the obligations undertaken by the contracting parties by its signing and especially those that should be undertaken in order to protect, preserve and improve the environment. The obligations on the protection, conservation and improvement of the environment imply the adoption of the appropriate national regulations and policies to mitigate the effects of climate change. In this regard, the Treaty establishing the Energy Community aims to contribute to the strengthening of the regional ties, and to the faster economic and political integration of the countries of Southeastern Europe into the European Union. Starting from the fact that the functioning of the internal energy market of the European Union presupposes a single legal framework in all the territories in which it is applied, the contracting parties to the Treaty establishing the Energy Community which are not the members of the European Union are obliged to harmonize their internal legislation with the law of the European Union. This, per se, includes the harmonization of regulations in the field of environmental protection.
