Summary/Abstract: The protection of natural persons with respect to the processing ofpersonal data is a fundamental right prescribed by Article 8 (1) of the Charter ofFundamental Rights of the European Union and Article 16 (1) of the Treaty on theFunctioning of the European Union (TFEU). Rapid technological development andglobalization brought new challenges to the protection of personal data. Thetechnology allows the processing of personal data on an incredible scale in order tocarry out activities such as prevention, investigation, detection or prosecution ofcriminal offenses or the execution of criminal sanctions. The European Union,therefore, adopted the Directive 2016/680 on 27 April 2016, which regulated theprotection of natural persons for the processing of personal data by the competentauthorities for the purpose of prevention, investigation, detection or prosecution ofcriminal offenses or for the enforcement of criminal sanctions, i.e. to facilitate thefree movement of such data, together with the General Data Protection RegulationEU 2016/679 (GDPR). The author deals with the analysis of the content of theDirective and the purpose of its adoption. The author devotes special attention tothe issue of the importance of the EU Directive 2016/680 for the legal order of theRepublic of Serbia. In this regard, the author appeals to raise awareness of theimportance of the EU Directive 2016/680 in the process of adopting a new Law onthe Protection of Personal Data and harmonization of internal legislation with theEU acquis in this area.
