The course of the obsolescence deadline in the context of optional stay of proceedings pursuant to article 413(1) pt. 1 Code of civil procedure

Summary/Abstract: In the present study we analyse the correlation between the institution of optional stay of proceedings and the institution of obsolescence of proceedings, focusing on the mechanisms by which the parties in a lawsuit and/or their creditors can request the resumption of proceedings in order to interrupt the obsolescence deadline. Hence, we begin with a brief overview of the two aforementioned institutions, then we present our view on how the parties and/or their creditors could interrupt the obsolescence deadline by making a request for the resumption of proceedings, and finally we present our conclusions on the analysed issues.
