DEVELOPMENT OF LEGAL REGULATION OF EXECUTION OF MONETARY OBLIGATIONS

Summary/Abstract: According to the Civil Procedure Act, the enforcement of monetary claims includes movable and immovable property; personal detention of the debtor. The Order on Order Proceedings gives executive force to acts with a higher degree of indisputability, certifying receivables. Under the Civil Procedure Code of 1952, enforcement has a limited scope - there are almost no contractual relations between individuals. Relations between enterprises are subject to special rules, which rarely lead to enforcement. The new Civil Procedure Code of 2008 corresponds to the processes of globalization and integration of the countries in the international community, that also cover Bulgaria.
