Summary/Abstract: The article is a commentary to the judgment of the Court of Justice of the European Unioninterpreting for the first time the factor of the place of direct damage, which is important in thecontext of pursuing claims by indirect victims - family members of a person who died as a resultof a road accident. The considerations of the Court are also important for the practice of applyingthe law in Poland and are an expression of efforts to consistently apply EU provisions onjurisdiction and the law applicable to cross-border torts.
