Summary/Abstract: This study aims to highlight the provisions of The Geneva Convention on the Refugee Status, which is determinant for defining the notion of refugee and the right to asylum as a fundamental right of the European Union. The special significance of the Charter in this field is reflected by the fact that it raises the right to asylum at the rank of a norm in EU primary law, since according to Article 6 of the Treaty regarding the European Union, the Charter ”has the same juridical value as that of the treaties”.
