Summary/Abstract: The contract, as source of rights and obligations, has the most important consequences in day to day life, sometimes being called “the law of given word”. Through the current paper, we aim to analyze contractual liability given the current laws, starting from pointing out the general legislative background and reaching the conditions for contractual liability, as well as the causes for exoneration and the effects of contractual liability, as regulated by the new Civil Code.
