Summary/Abstract: Demographic trends as well as changes in population’s characteristics and economic changes in the EU countries evoked legal changes (amendments) of the legal regimes of fundamental function of state pension systems (PS) of the obligatory PI established at the end of XIX and the beginning of XX century. In the EU countries, state PS of obligatory PI with one form of the legal regimes of fundamental function of generation solidarity have been supplemented with another form of the legal regimes of fundamental function of the capitalized coverage in the third part of XX and at the beginning of XXI century. Therefore, in the contemporary comparative law (EU) there is the state PS of the obligatory PI with two forms of the legal regimes of fundamental function: 1. Generation solidarity (Pay-As-You-Go or PAYGPS); and, 2. Capitalized coverage (Fully Funded).
