Summary/Abstract: The reasoning of the court decision, including in the preliminary chamber procedure is a matter of science, first of all, but also of art. Thus, the judge being previously and permanently correctly evaluated / appreciated, he should benefit from the presumption of judicial common sense, as a person endowed with conscience, be it a legal one. In this activity, the judge must ponder on what Brâncuşi said about genius, that is, to create as a god, to rule as a king and to work as a slave, thereby ensuring that they still live in our legal space, in a broad sense, and in a narrow sense, in the space of Romanian justice.
