Summary/Abstract: The article examines the theoretical and legal features of the formation and development of the judicial system in modern conditions. Various theoretical approaches to understanding the role of the judiciary in the process of state formation are analyzed. International legal documents are studied, which are devoted to the functioning of the judiciary, ensuring its independence and guarantees of judges. It is noted that today, at a time of challenges for the peoples and states that have chosen the democratic path of development, including Ukraine, it is important to ensure the continued effective functioning of the judiciary in view of international standards of its construction and development.
