CRIMINAL OFFENCE OF ENDANGERING THE SAFETУ OF PERSONS UNDER INTERNATIONAL PROTECTION (ARTICLE 155b OF THE CLY)

Summary/Abstract: This criminal offence has been introduced into Yugoslav criminal legislation by amending the CLУ in 1990. According to the provisions of article 155b of the Law, the offence consists of kidnapping or of other act of violence against a person under international protection, then of attacking his official premises, private apartment or transportation vehicle (paragraph 1), or endangering his safety by a serious threat of attacking his person, his official premises, private apartment of transportation vehicle (paragraph 4). The Law provides for two serious forms, too. To first exists of, due to committing the basic act specified in par. 1, a serious consequence does take place in the form of death of one or several persons (par. 2) and the second, the most serious form of this criminal offence, exists if, in committing to act specified in par. 1, a person has been wilfully killed (par. 3). Offences specified in par. 1. are threatened by imprisonment of not less than one year, while that in par. 4 - by imprisonment of not less than five years. The gravest offence (par. 3) is punishable by imprisonment of not less than ten years or by capital punishment.
