Delimitation of working time by rest time for mobile workers engaged in railway transport activities

Summary/Abstract: Work organisation in railway transport has some particularities with direct effect on the organisation of railway employees’ working time. The article presents some issues regarding the delimitation of working time from rest time that occur in practice, namely the issue of rest away from home periods, of waiting and of travel time before starting the work. These issues are analysed in the light of national regulation, Directive 2003/88/EC, Directive 2005/47/EC, CJEU and national courts case law. The article emphasises the important difference between the legal regime of working time for the purpose of health and security at work protection and the legal regime of overtime for additional work for the purpose of salary rights determination.
