WOMAN AS THE EXECUTION EMANS IN THE CUSTOMARУ LAW OF ALBANIANS

Summary/Abstract: In Albanian villages woman is considered a thing (in Roman law-res, Albanian term - gja). It is a most precious thing which is used only as ultimate means to exert pressure against the offended party to pardon the debt in blood ant to consent to material compensation. A woman is a thing (object) which is appropriate, in the final analysis, to be the means of execution in order to effect payment of a property claim. By threating to effect execution over women, the creditors, and more particularly the custodians of the so-called bessa (Albanian word of honour guarantying the fulfilment of an obligation), or the guarantors, are sure to be able to collect their claims.By effecting the execution over women in fact means the abduction of women and the murder of their husbands. Therefore the Albanians do not allow the execution over women even if they would loose their life.
