Assimilated smuggling offense and its (un)constituional avataries

Summary/Abstract: This study analyzes the effects of the publication of Decision no. 176 of March 24, 2022 of the Constitutional Court of Romania on the provisions of art. 270 para. (3) of the Customs Code which criminalizes the crime of assimilated smuggling, starting from the causes of this circumstance generated by the mandatory interpretation given by the High Court of Cassation and Justice to the notion of „smuggling” by the Resolution of release no. 32 of December 11, 2015.
