Summary/Abstract: This article aims to analyze some of the problems that may arise from the deficient and incomplete wording of art. 335 of the Criminal Procedure Code, starting from a recent case brought before the courts, concluding with the fact that this article is not appropriately correlated with other provisions governing related procedures, but also lacking the required accuracy, which generates potentially harmful consequences.
