Summary/Abstract: The Romanian Constitution includes the state of emergency as one of two extraordinary measures. Measures taken during a state of emergency invariably limit the exercise of certain rights and freedoms, which is why constitutional and legal provisions must be in place to ensure that this restriction is not abusive. The legal nature of the decree has been the subject of differing opinions in the doctrine.
