Summary/Abstract: Current challenges for both international community and national states during the war in Ukraine and the consecutive humanitarian, economic, diplomatic crisis rise the need to prosecute at national level in an efficient manner international crime: genocide, war crimes, crimes against humanity. Romania has a difficult task being in the close vicinity of the war, but also is a part of an international treaties system which allows to investigate foreign citizens for crimes committed abroad, even with some restrictive conditions. It is a future task to analyse if an amendment of the Penal Code is needed in order to eliminate the restrictive conditions.
