Summary/Abstract: The state protection conferred to the factual unions is a reality that has spread through diverse legal systems. Despite the legal recognition in Brazil, Uruguay and Argentina, concerns remain about the regulation of stable unions, which justifies the comparative analysis of the legislation. Without the intention to exhaust the theme, the central objective is to observe the regulations foreseen in each codification, seeking to highlight converging, dissonant point and regulation dilemmas. The conclusion is that the legal provisions present more distinguishing points than analogous ones, bringing all of them advantages and disadvantages, depending on the option for major state intervention or private autonomy.
