Mediator’s liability insurance – compulsory or voluntary?

Summary/Abstract: In Poland the profession of mediator is not associated with compulsory civil liability insurance. The article refers the analysis of the current status of the mediator’s profession and the perspective of its development (including those related to constant professionalization), presents the situation regarding voluntary civil liability insurance of mediators and attempts to identify risks related to the civil liabil- ity of mediators. The author critically assesses the lack of statutory guarantees for the exercise of the profession of mediator by persons with appropriate qualifications and points to the need to organize the legal status of this profession and the legal protection of the professional title. The author comes to the conclusion that in relation to mediators, the conditions indicated in the literature as a justifica- tion for compulsory civil liability insurance are not currently met
