Summary/Abstract: Different kinds of witnesses cause different problems in the sphere- of wills in Yugoslav law. There are witnesses to identity, witnesses to a will and witnesses to probate of a will. The author particularly elaborates the second type of vitnesses discussing their role in different forms of wills. Answers useful both for the theory and the practice are suggested, namely: who may be a witness in the law of wills, special characteristics, of the witness, the possibility to be a witness in different capacity- to the same will, eventual liability of witnesses in some cases of successors suffering damage. The character of sanctions for the violation of legal rules on witnesses to a will are discussed at the end of the article, together with raising criticism as to certain disharmony in Yugoslav law regarding the- above rules. This emphasizes the need for introducing amendments in relevant legislation.
