Summary/Abstract: The column concerns the issue of the Constitutional Tribunal verdict of 22 October 2020, K 1/20, on the non- compliance with the Constitution of Article 4a(1)(2) of the Polish abortion law (the Family Planning, Protection of the Human Foetus and the Conditions of Admissibility of Termination of Pregnancy Act), i.e., the condition allowing abortion where medical tests or other medical conditions indicate a high probability of a serious and irreversible impairment of the foetus or an incurable disease threatening its life (the so-called embryological condition). In the article, the author will try to answer the question to what extent the verdict of the Tribunal, taking into account that this authority is competent to adjudicate on the hierarchical compliance of legal acts with the Constitution of the Republic of Poland, narrows the scope of civil rights and freedoms by extending the scope of the criminality of pregnancy termination.
