Outsourcing Municipal Waste Management

Summary/Abstract: Waste management is one of the tasks of maintaining cleanliness and order in municipalities. It’s a fragment of the municipal economy, which includes, in particular, tasks related to public services. As a rule, local governments, including municipalities, are free to choose how and in which form to conduct municipal management. One of the tasks, where the particular regulations provide for limiting municipality autonomy in choosing the methods and forms of conducting municipal management is related to municipal waste management. Tasks carried out in this area may be delegated only after public tender, which is mostly regulated by the Public Procurement Act. Such a legal status means that even municipal companies must stand for tender, and self-government financial institutions are prevented from performing these tasks.
