WITH CARDS ON THE TABLE IN THE SIMULATION STATEMENT

Summary/Abstract: This article examines the main elements of the concept of simulation in civil law, a legal operation that seeks to create an appearance, represented by the public act, while the act that produces the real effects is the secret or real act, which is hidden from third parties. In this sense, the conditions, forms and effects of the simulation are presented, together with jurisprudential aspects of the CJEU, the Romanian Constitutional Court and the civil section courts, but also the previous regulation viewed from a doctrinal perspective.
