The Social Credit System As a Contemporary Version of the Legal Policy

Summary/Abstract: RESEARCH OBJECTIVE: The main goal of the article is to analyze the general principles of operating of the Social Credit System (SCS) in the context of the assumptions underlying the concept of the legal policy proposed by Leon Petrażycki. Based on new technologies the Social Credit System is currently tested and implemented by the government of the People’s Republic of China. THE RESEARCH PROBLEM AND METHODS: SCS is grounded on the idea that it can change or modify the behavior of citizens and entrepreneurs, and finally it will lead to the reinforcement of the desired behaviours and the elimination of socially negative attitudes. The key problem – whether the SCS can be considered as a modern version of legal policy – is analyzed in this text. To this purpose, the following research methods will be used: historical and philosophical analysis of Leon Petrażycki’s theory, conceptual and theoretical analysis of the main assumptions of SCS. THE PROCESS OF ARGUMENTATION: Firstly the basic assumptions of Leon Petrażycki’s legal policy concept are presented. Following that, the principles and methods of the SCS functioning are considered. Especially, the status and the characteristics of the rules of conduct verified by the system that is based on trustworthiness are closely examined. RESEARCH RESULTS: As a result of the analysis, the SCS can be considered as a modern attempt to implement the assumptions of legal policy, in which the potential of new technologies is used. CONCLUSIONS, INNOVATIONS, AND RECOMMENDATIONS: The discussed way of using technological and IT tools to develop systems similar to SCS, including the future possibility of implementing artificial intelligence in such system, raises many concerns, the most important of which are indicated in the text.
