The sanctioning powers of the Banco de España within the framework Unique Supervisory Mechanism. Overview and challenges

Summary/Abstract: This paper contains the brief presentation passed on 18 th April 2018 in Bucharest (Romania) during the International conference: “Key Legal Issues in the Financial and Banking Field”. This paper focuses on the allocation of sanctioning competencies within the Single Supervisory Mechanism (SSM) and its potential developments. In connection with this framework, this work outlines some particularities of the sanctioning proceedings instructed by Banco de España and points out some potential issues that may arise under the legal framework depicted by the SSM, suggesting potential interpretations to overcome those issues as well.
