Summary/Abstract: The present study aims to examine whether the filed declaration action under Art. 126 of CPC will lead to termination of the later filed declaration action under Art. 422 of CPC in the warrant procedure, because there is identity between the parties, the subject and the request of the actions. Due to the nature of warrant procedure, the legal interest and the legal protection sought with the two claims is different and an identity between them cannot be determined.
