REFORM OF THE DISPUTE SETTLEMENT MECHANISM IN THE ENERGY COMMUNITY

Summary/Abstract: The Energy Community was established by an international treaty in 2005 in Athens concluded between the European Union and the states from the South East Europe. The main aim of the Energy Community is to establish among the parties an integrated market in natural gas and electricity. In this paper the author consider the question whether the existing dispute settlement mechanism fulfils the needs and aims of the Energy Community. It is the opinion of the author that the existing system is inadequate and represent the weakest point in the legal and institutional system of the Energy Community. With that regard the author also analyze proposals made by High Level Reflection Group for the reform of the existing mechanism which should ensure the full observance and efficient implementation of the Energy Community Law.
