Summary/Abstract: Ship recycling is an integral segment of maritime governance. It is also economically justified.On the other hand, it is associated with a real threat to human life and health, as well as theenvironment, especially if there is no legal framework regulating the scrapping process. Thisproblem has been recognized internationally, resulting in the adoption of the InternationalConvention for the Safe and Environmentally Sound Recycling of Ships, which is the most comprehensivepossible response to the challenges of ship recycling. If the Convention comes intoforce, it will radically change the legal situation and the obligations of the shipowner and othersregarding the design, construction, operation, and recycling of ships. As a consequence, it willlead to a significant reduction of the risks to human health and life and the environment. At present,the condition regarding the number of ratifications, which is seventeen out of the fifteenrequired, has been met. Unfortunately, 10.23% of the world’s gross tonnage is missing for theConvention to enter into force.
