Limitation Period for Claims under a Contract for Carriage of Goods by Sea

Summary/Abstract: The Author analyses the judgment of the Court of Appeal in Łódź regarding the interpretation ofart. 108 of the Maritime Code. The commented judgment raises the issue of the limitation periodfor claims under a contract for carriage of goods by sea. The Author shares the standpoint of theCourt of Appeal which acknowledges that the one-year limitation period applies to claims ofa legitimate holder of a bill of lading against a carrier. However, this time limit does not applyto claims between the carrier and the freight forwarder as parties to a contract for carriage ofgoods by sea, even if a bill of lading has been issued.
