Summary/Abstract: The right of petition represents at the same time a fundamental right provided by the Romanian Constitution (article 51) and a consecrated right in the European Union, provided by the Charter of Fundamental Rights of the European Union (article 44). Rosia Montana became a well known subject when the project regarding the mining of this area was promoted. After several contradictory discussions along the citizens and after realizing the tremendous impact that such a project could have on the environment, a petition was drafted and sent to the Committee on Petitions of the European Parliament. This way, the matter was referred to the Committee, providing to it information about the fact that the mining project from Rosia Montana is incompatible with the principle of sustainable development promoted by the European Union. The main question that this article is trying to respond to is reduced to “is the right for petition fully respected?”. The purpose of the essay is to emphasize and demonstrate the whole process of analyzing and resolving this petition. Furthermore, the final objective is to submit a legal and fairly moral solution, keeping in mind the better practices within the domain of the right of petition.
