Summary/Abstract: The Pope Francis in Motu Proprio "Mitis Iudex Dominus Iesus" ~ introduced a new institution of pre-judicial inquiry. It is to assist the Christian faithful in getting to the truth about legalstanding of their bond of marriage. The article concerns the role and tasks of the new institution in the canon process on the nullity of marriage. The writer shows the substantial differencebetween pastoral inquiry and the inquiry in criminal investigation. Moreover, the tasks of the local ordinary are presented, and people who can function within the pre-judicial inquiry aredefined. Giving background and describing the circumstances which may indicate the application of the briefer matrimonial process before the bishop are also relevant issues of the article.
