Completeness of the legal system. The legis analogy as a method of filling gaps in the law

Summary/Abstract: The main research problem analyzed in this article is the approach to the issue of applying the law by analogy, and specifically – inference per analogy about the validity of a given legal norm from a legal provision (analogy legis), or from law in general (analogy iuris). At the same time, it is not so much a separate method of applying the law as a method of its interpretation. We should talk here about the interpretation of the largo sense – a legal inference based on a relationship of similarity, aimed at formulating on the basis of the axiology of the legal system the premise of a greater legal syllogism for the needs of a given case.
