Summary/Abstract: This article contains a comparative analysis of the legislative interpretation of the right of retention of the pledge in unsecured credits in the regulation of this issue in the civil codes of the Ibero-American countries, and shows that for most of them the distant common denominator is the rescript of the Roman emperor Gordian III (239 AD), included in CJ. 8, 26 (27), 2, which provides for the so-called pignus Gordianum.
