Summary/Abstract: This article examines the issue of automation of the power of judging in the context ofcontemporary threats to democracy posed by the new technologies of power emergingfrom the combination of big data digital capitalism and artificial intelligence. Theautomation of judging and decision-making not only raises concerns about fairness,transparency and political accountability, but also confronts us with the fundamentalquestion of whether algorithmic governance is still democratic governance, consistentwith participatory democracy understood as the rule of the people. And if not, whatpolitical form emerges from governing people according to an algorithm?
