Summary/Abstract: The focus of the article is the analysis on the proportionality and the compatibility with the contemporary international standards of the disqualification of persons with intellectual disorders and mental health issues from political participation. The author outlines the legal regulation in European Union member states on the matter and the relevant case law of the European constitutional jurisdictions. The emphasis is put on challenges before the Republic of Bulgaria, following the ratification of the UN Convention on the Rights of Persons with Disabilities and the possible paths for adapting the legislation to the new paradigm concerning the political participation of persons with mental issues.
