Summary/Abstract: The formal-dogmatic analysis of the norms applicable to the liability for damages in connection with criminal proceedings has led to the conclusion that within the scope not regulated in Chapter 58 of the Code of Criminal Procedure the general rules of a tort regime or a regime of liability for damage caused in the exercise of public authority or special provisions (other than Chapter 58 of the Code of Criminal Procedure) generally apply. Numerous cases of damage caused by the exercise of public authority remain unregulated in this chapter. These include damage caused by the public prosecutor’s conduct, including the filing and sustaining of an indictment by the prosecutor. Chapter 58 of the Code of Criminal Procedure does not constitute a comprehensive regulation but a fragmentary one, therefore, it is advisable to transfer its norms to the Civil Code.
