Brief considerations with regard to the offence of child pornography punishable under Article 374 paragraph 1^1 of the Romanian Criminal Code

Summary/Abstract: The aim of this article is to analyse Article 374 paragraph 11 of the Romanian Criminal Code. Firstly, the author presents several definitions of „child pornography” and then argues that that the variant of child pornography under Article 374 paragraph 11 must be treated as a special type of trafficking underage victims. Likewise, the author analyses whether the offence of child pornography can be considered to be a special type of exploitation of vulnerable persons. Finally, the author emphasizes several arguments in order to conclude if the offence punishable under Article 374 paragraph 11 of the Romanian Criminal Code is truly an offence against the public order and peace.
