Summary/Abstract: Purpuse – Analysis of the possibility of using PL REIT to revive the rental housing sector in Poland and indication of elements enabling the business use of these instruments. Methodology – Analysis of the last draft of the PL REIT act, which was to introduce REITs to the Polish legal system in 2019, and the text of the earlier draft act, which was to introduce this investment vehicle in 2017 - tracking the evolution. The provisions of the draft acts were compared with the conclusions resulting from the discussion currently conducted by experts. The proposed solutions from 2018 were compared with the solutions used in the European Union. Findings – The draft act, which allows the possibility of investing only in rental apartments, raises doubts. The experiences of the European Union countries show that the enactment of a legal act does not guarantee the existence of REITs in economic life. Investing in real estate is a long-term process and it takes time to build appropriate organizational structures, hire experts and develop pathways. Investors may be afraid of the risks associated with REITs. Ensuring their safety will require the creation of control entities and assigning them appropriate powers and roles, thus ensuring appropriate supervision. For the proper functioning of REITs, significant capital from both institutional and individual investors is necessary. Attracting the capital of individual investors will require the introduction of a stimulator, a mobilizing factor.
