Liability of digital service providers through the lens of copyright. The Romanian jurisprudential perspective

Summary/Abstract: The regime of exemption from liability with respect to those information society service providers of a purely technical, automatic and passive nature has been outdone. In particular, for those providers who carry out a hosting activity. The law tries to adapt the new regime by allowing these operators to benefit from exemption solutions in many cases. Whether or not this new regime will achieve its goals is difficult to say. It will also depend on how the EU Court of Justice will outline the meaning of some notions formulated in a general manner.
