Summary/Abstract: The authors examine, partially with criticism, a series of labor law provisions, stipulated in the Framework Law no. 330/2009 on the unitary pay system for the personnel paid out of public funds, the Law no. 329/2009 on the reorganization of public authorities and institutions, rationalization of public spending, supporting the business environment and meeting the framework agreements with the European Commission and the International Monetary Fund and in the Government Emergency Ordinance no. 1/2010 regarding certain measures for the reemployment of categories of civil servants and the establishment of their salaries, as well as other measures in the budgetary field and a series of Constitutional Court statements contained in this Court’s rulings no. 1415/2009 and no. 1414/2009 (which stated that the two above-mentioned rules are constitutional). The main themes discussed here concern: the issue of the two laws’ organic or ordinary nature; general issues regarding the pay system for civil servants, regulated by Law no. 330/2009; percentage limitation of the additional compensations due to civil servants; remuneration of the activity carried out by civil servants at night; plurality of positions and cumulation of pension with the salary by civil servants; special conditions regarding collective negotiation; the transitory/temporary nature of Law no. 330/2009.
