Summary/Abstract: Preventive measures are procedural measures with a binding character. They have the role of restricting the freedom of those over whom there is suspicion that they have committed an act provided by the criminal law. The aim of those measures is to ensure the proper conduct of the criminal trial, preventing the suspector defendant from being evaded from prosecution or trial or from being prevented from committing another crime. This article aims to analyze the issues related to the activity of the court clerk in a panel of rights and freedoms in cases having as object the proposal to take the measure of preventive arrest and house arrest.
