Summary/Abstract: The article analysis the problem of jurisdiction of military courts and military prosecutor’s offices starting from crimes against operational capacity of military forces, emphasizing the legal aspects concerning civilian persons which are not military but have a similar status or even title. The conclusions concern the methodological stage of the verification of the military rank and the need to review the code of criminal procedure.
