Preliminary Civil Proceedings and Enforcement Proceedings

Summary/Abstract: The first part of the paper is devoted to the foundations and limitations of the principle of nonest inchoandum ab executione, according to which the civil proceedings cannot begin with theenforcement. Then, the problem of the separation of preliminary civil proceedings and enforcementproceedings is presented, taking into account their functional and structural differences.Against this background, the issue of the appropriate application of provisions concerning contentiousproceedings to enforcement proceedings was raised. The final part of the paper coversthe problem of codification of judicial enforcement proceedings.
