Extrajudicial Methods of Dispute Resolution – Mediation and Arbitration in the Codeof Civil Procedure Model

Summary/Abstract: The aim of the article is to present extrajudicial (amicable) methods of dispute resolution (settlement),i.e. mediation and arbitration in the Code of Civil Procedure model. In order to presentthis issue in a holistic way, the concept of “extrajudicial (alternative) means of dispute resolution”is presented, the current legal status of mediation and arbitration in Poland and in foreign legalsystems is indicated and, finally, a model in the Polish legal system is proposed by adoptingthree concepts that can be a starting point for further consideration of possible changes.
