Summary/Abstract: The article contributes to the discussion on the desirable normative model of civil investigativeproceedings in contentious matters in terms of its unification or, alternatively, further diversification.The reference point for the considerations are the solutions proposed in the ELI/UNIDROITModel European Rules of Civil Procedure. Following these regulations, the author advocatesa far-reaching unification of civil procedure in contentious cases based on a maximally flexibleprocedural framework. It should assume broad judicial discretional powers in the field of directingand managing proceedings in manner subordinated to the pursuit of the implementation ofthe purpose and functions of the process. It should also take into account the main proceduralprinciples, with the special recognition of the principle of cooperation between the court andthe parties, and the principle of proportionality.
