On the scope of compensation obligation of insurance companies under motor vehicle third party liability insurance with respect to discounts and rebates

Summary/Abstract: The author analyses the issue of covering the possible discounts obtained by the aggrieved party from workshops cooperating with the insurance company with the compensation due from the insurance company under motor vehicle third party liability insurance determined according to the cost estimate method. His standpoint is that the insurer’s liability does not in principle include possible discounts (ex- cept for cases of servicing the vehicle in an authorised service stations or remaining under warranty).
